1. Agreement to Terms

By accessing or using Mockup Maestro ("the Service"), a product of Colony Pictures LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO WARRANTY IS PROVIDED THAT THE SERVICE WILL BE ERROR FREE, UNINTERRUPTED, SECURE, OR WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

IN NO EVENT SHALL COLONY PICTURES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SERVICE.

4. Indemnification

You agree to indemnify, defend, and hold harmless Colony Pictures LLC, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorneys' fees) relating to or arising out of:

• Your use of or inability to use the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Your violation of any applicable laws, rules, or regulations
• Any claims that your content caused damage to a third party

5. Service Terms

• We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice
• We make no guarantees about the reliability, availability, or performance of the Service
• We reserve the right to refuse service to anyone for any reason at any time
• Account termination may occur for any violation of these Terms

6. Your Content and Conduct

• You retain all rights to your designs and content
• We will never use, reproduce, modify, distribute, or interact with your content in any way except to provide the requested service functionality
• All your content remains exclusively yours and private
• We do not claim any rights or licenses to your content
• You are solely responsible for your conduct and any data, text, files, information, usernames, images, or other content that you submit, upload, or display on or via the Service
• You must have the legal right to all content you upload to the Service

7. Termination

• We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason
• Upon termination, your right to use the Service will immediately cease

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

10. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Colony Pictures LLC. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

NEVERTHELESS, THE SERVICE IS PROVIDED STRICTLY "AS IS" AND WE MAKE NO GUARANTEES OR WARRANTIES WHATSOEVER. WE ACCEPT NO RESPONSIBILITY FOR:

• Service interruptions or downtime
• Loss of data or content
• Issues with third-party integrations
• Business losses or damages
• Technical issues of any kind
• Results or outcomes from using our service
• Any direct, indirect, incidental, or consequential damages
